本議定書各締約國,
作為1969年11月29日在布魯塞爾簽訂的國際干預公海油污事故公約的締約國,
考慮到1969年海洋污染損害國際法律會議所通過的關於非油類污染物的國際合作決議,
還考慮到,按照該項決議,政府間海事協商組織*與一切有關的國際組織合作,已加強了其在非油類污染物的各個方面的工作,茲協定如下:

第一條
1.本議定書的締約國,在發生海上事故或與這種事故有關的行為後,如有理由預計到將造成重大的有害後果,則可在公海上採取必要的措施,以防止、減輕或消除由於非油類物質造成污染或污染威脅而對其海岸或有關利益產生的嚴重而緊迫的危險。
2.第1款中所指的“非油類物質”為:
(1)列於由本組織指定的適當機構所制訂的名單中的物質,該項名單應作為本議定書的附屬檔案,以及
(2)其他易於危害人類健康,傷害生物資源和海生物、損害休憩環境或妨害對海洋的其他合法利用的物質。
3.每當進行干預的締約國就上述第2款第(2)項中所述物質採取行動時,該締約國有責任確證,該物質在進行干預時的情況下,會產生類似於上述第2款第(1)項所述名單中列舉的任何物質所產生的嚴重而緊迫的危險。
第二條
1.1969年干預公海油污事故公約第一條第2款和第二至八條以及其附屬檔案的規定,應如同其適用於油類一樣,適用於本議定書第一條中所述的物質。
2.就本議定書而言,該公約第三條第3款和第四條中所述的專家名單應予擴大,以包括能在非油類物質方面提供意見的專家。其人選由本組織的會員國和本議定書的締約國提出。
第三條
1.第一條第2款第(1)項中所述的質物名單,應由本組織指定的適當機構保持常新。
2.本議定書的任一締約國對該名單所提議的修正案,應提交本組織,並由本組織在該適當機構對之進行審議前至少3個月轉發給本組織的所有會員國和本議定書的所有締約國。
3.本議定書的締約國,不論其是否為本組織的會員國,均有權參加該適當機構的會議。
4.修正案須以到會並投票的本議定書締約國的2/3多數票通過。
5.修正案如按上述第4款的規定獲得通過,則本組織應將其通知本議定書的所有締約國,以供接受。
6.該修正案,在通知後滿6個月時,應視為已被接受,除非在此期限內有不少於1/3的本議定書的締約國通知本組織表示反對。
7.凡按上述第6款規定視為已被接受的修正案,應在其被接受後過3個月,對本議定書的所有締約國生效,但對在該日期前聲明不予接受者除外。
第四條
1.本議定書對已簽署或已加入第二條中所述公約的國家和被邀請出席1973年國際海洋污染會議的國家開放供簽字,並自1974年1月15日起至1974年12月31日止在本組織總部繼續開放供簽字。
2.除本條第4款的規定外,本議定書須經已簽字的國家批准、接受或認可。
3.除第4款的規定外,本議定書應對未簽字的國家開放供加入。
4.本議定書只可由業已批准、接受、認可或加入第二條中所述公約的國家批准、接受、認可或加入。
第五條
1.批准、接受、認可或加入,須以相應的正式檔案交存本組織秘書長。
2.在本議定書的一項修正案已對所有現有締約國生效之後或者在為該項修正案對所有現有締約國生效所需的一切措施均已完成之後交存的任何批准、接受、認可或加入的檔案,應認為適用於按該修正案所修訂的本議定書。
第六條
1.本議定書應在已有15個國家向本組織秘書長交存批准、接受、認可或加入檔案之日後第90天生效,但本議定書不得在第二條中所述的公約生效之前生效。
2.對於隨後批准、接受、認可或加入本議定書的每個國家,本議定書應在該國交存相應的檔案後第90天對之生效。
第七條
1.本議定書的任何締約國,可在本議定書對之生效之日後,隨時退出本議定書。
2.退出本議定書須以相應的檔案交存本組織秘書長。
3.退出本議定書,應在將退出檔案交存本組織秘書長後經過1年或該檔案中所指明的較長期限屆滿後生效。
4.本議定書的一締約國退出第二條所述的公約,即應視為也退出本議定書。這種退出,應在按照該公約第十二條第3款退出該公約生效之日同時生效。
第八條
1.本組織可召開修訂或修正本議定書的會議。
2.在有不少於1/3的本議定書的締約國提出要求時,本組織應召開締約國會議,以修訂或修正本議定書。
第九條
1.本議定書應交本組織秘書長保存。
2.本組織秘書長應:
(1)將下列情況通知所有已簽署或加入本議定書的國家:
①每一新的簽字或檔案的交存,以及其日期;
②本議定書生效的日期;
③任何退出本議定書的檔案的交存以及退出生效的日期。
④對本議定書或其附屬檔案的任何修正案,以及對該修正案的任何反對或不予接受的聲明;
(2)將核證無誤的本議定書的副本分送給已簽署或加入本議定書的所有國家。
第十條
本議定書一經生效後,本組織秘書長應即按聯合國憲章第一百零二條的規定,將核證無誤的副本一份送聯合國秘書處登記和公布。
第十一條
本議定書正本1份,用英文、法文、俄文和西班牙文寫成,四種文本具有同等效力。
經正式授權的下列具名代表特簽署本議定書,以昭信守。
附屬檔案:本組織海上環境保護委員會根據第一條第2款第(1)項制訂的物質名單
國際海事組織於1973年11月23日在其第八屆大會上以決議A·296(Ⅷ)指定海上環境保護委員會為本議定書第一條第2款第(1)項所述的適當機構。海上環境保護委員會經過審議,於1974年11月21日以決議MEPC·1(Ⅱ)通過了此附屬檔案。

1.PartiestothepresentProtocolmaytakesuchmeasuresonthehighseasasmaybenecessarytopreventmitigateoreliminategraveandimminentdangertotheircoastlineorrelatedinterestsfrompollutionorthreatofpollutionbysubstancesotherthanoilfollowinguponamaritimecasualtyoractsrelatedtosuchacasualty,whichmayreasonablybeexpectedtoresultinmajorharmfulconsequences.
2."Substancesotherthanoil"asreferredtoinparagraph1shallbe:
(a)thosesubstancesenumeratedinalistwhichshallbeestablishedbyanappropriatebodydesignatedbytheOrganizationandwhichshallbeannexedtothepresentProtocol,and
(b)thoseothersubstanceswhichareliabletocreatehazardstohumanhealth,toharmlivingresourcesandmarinelife.todamageamenitiesortointerferewithotherlegitimateusesofthesea.

ArticleII
1.Theprovisionsofparagraph2ofArticleIandofArticlesIItoⅧoftheConventionRelatingtoInterventionontheHighSeasinCasesofOilPollutionCasualties,1969,andtheAnnextheretoastheyrelatetooil,shallbeapplicablewithregardtothesubstancesreferredtoinArticleIofthepresentProtocol.
2.ForthepurposeofthepresentProtocolthelistofexpertsreferredtoinArticlesIII(c)andIVoftheConventionshallbeextendedtoincludeexpertsqualifiedtogiveadviceinrelationtosubstancesotherthanoil.NominationstothelistmaybemadebyMemberStatesoftheOrganizationandbyPartiestothepresentProtocol.
ArticleIII
1.Thelistreferredtoinparagraph2(a)ofArticleIshallbemaintainedbytheappropriatebodydesignatedbytheOrganization.
2.AnyamendmenttothelistproposedbyaPartytothepresentProtocolshallbesubmittedtotheOrganizationandcirculatedbyittoallMembersoftheOrganizationandallPartiestothepresentProtocolatleastthreemonthspriortoitsconsiderationbytheappropriatebody.
3.PartiestothepresentProtocolwhetherornotMembersoftheOrganizationshallbeentitledtoparticipateintheproceedingsoftheappropriatebody.
4.Amendmentsshallbeadoptedbyatwo-thirdsmajorityofonlythePartiestothepresentProtocolpresentandvoting.
5.Ifadoptedinaccordancewithparagraph4above,theamendmentshallbecommunicatedbytheOrganizationtoallPartiestothepresentProtocolforacceptance.
6.Theamendmentshallbedeemedtohavebeenacceptedattheendofaperiodofsixmonthsafterithasbeencommunicated,unlesswithinthatperiodanobjectiontotheamendmenthasbeencommunicatedtotheOrganizationbynotlessthanone-thirdofthePartiestothepresentProtocol.

1.ThepresentProtocolshallbedepositedwiththeSecretary-GeneraloftheOrganization.

(i)eachnewsignatureordepositofaninstrumenttogetherwiththedatethereof;
